Ownership Statement
This Ownership Statement clarifies the intellectual property rights concerning the design services provided by Pharhaan.com (“we,” “us,” or “our”) to our clients (“Client,” “you”). This document should be read in conjunction with our Terms and Conditions and any specific Service Agreement or Statement of Work (SOW) that governs our engagement.
1. Client Ownership of Final Deliverables
Upon full and final payment of all fees due for a specific project or retainer period, Pharhaan.com grants the Client a non-exclusive, worldwide, perpetual, and royalty-free license to use, reproduce, display, and distribute the final, approved deliverables specifically created for the Client under that agreement.
This means that once you have paid in full, you own the rights to use the finished UI designs, prototypes, social media graphics, or website designs for their intended business purposes.
Specifically, “final, approved deliverables” include:
The completed, high-fidelity UI screens and components as agreed upon in the final approval.
The interactive prototypes as delivered and approved.
The final versions of social media graphics, short-form videos, or marketing website designs.
Any specific design system components or documentation explicitly created and delivered as part of the project scope.
2. Pharhaan.com’s Retained Rights
Pharhaan.com retains all intellectual property rights, including copyrights, trademarks, and trade secrets, to the following:
Proprietary Tools & Methodologies: Any internal tools, processes, workflows, design methodologies, or intellectual property developed by Pharhaan.com that are used in the course of providing services.
Preliminary Designs & Unused Concepts: All preliminary designs, concepts, sketches, wireframes, mockups, iterations, or alternative designs that were not selected by the Client for final approval or implementation.
Pre-existing Assets: Any pre-existing design system components, templates, code snippets, or other assets owned by Pharhaan.com prior to the engagement, even if adapted or incorporated into the Client’s deliverables. These are licensed to the Client for use within the final deliverables but remain the property of Pharhaan.com.
General Knowledge & Expertise: The general knowledge, skills, and experience gained by Pharhaan.com during the engagement.
3. Portfolio & Promotional Rights
Unless explicitly agreed otherwise in a separate written agreement, Pharhaan.com reserves the right to:
Showcase the Client’s project (including screenshots, mockups, and case studies of the final deliverables) in its online portfolio (e.g., pharhaan.com, Behance, Dribbble).
Use the project for self-promotional purposes, marketing materials, and award submissions.
Briefly mention the Client’s name and project in marketing communications.
We understand the sensitive nature of unreleased products and will always coordinate with the Client regarding the timing and scope of any public display of work related to confidential projects.
4. Client-Provided Materials
The Client warrants that all materials, content, logos, trademarks, images, fonts, or other intellectual property provided to Pharhaan.com for use in the project are either owned by the Client or that the Client has obtained all necessary licenses, permissions, and rights to use them. The Client agrees to indemnify and hold harmless Pharhaan.com from any claims or damages arising from the use of materials provided by the Client that infringe on third-party intellectual property rights.
5. Third-Party Assets & Licensing
Where third-party fonts, stock photography, icons, software, or other licensed assets are used in the deliverables, the Client acknowledges that:
These assets are subject to their own respective licenses.
Pharhaan.com will advise the Client on the need to acquire appropriate licenses for these assets for their intended use.
The Client is responsible for purchasing and maintaining any necessary third-party licenses for their continued use of such assets.
